Stage One – Serve Notice on Tenant
Is your tenant in at least 2 months arrears of rent?
Do you want to obtain possession of your property?

The first stage to evict your tenant is to serve them with a Section 8 Notice.
At Stage 1, to evict tenants we will serve the tenant with a Section 8 Notice by first class post and recorded delivery. We will need to send a Section 8 Notice to each tenant individually.
This will give the tenant at least 2 weeks notice that they must either pay the outstanding arrears or you will obtain possession of your property (eviction).
The notice must have expired before you can move onto Stage 2 - issue possession proceedings.

Stage Two – Issuing Court Proceedings
Have you completed Stage 1?
Has your tenant still not left the property or paid the arrears?
Do you want to commence possession proceedings to evict your tenant?

If your tenant does not leave the property or pay the outstanding arrears after the Section 8 Notice expires, we can commence court possession proceedings.
Once we have issued the proceedings we will notify you of the hearing date (which is likely to be within the next 4 to 6 weeks), and arrange for an advocate to attend Court with you at the hearing.
Alternatively, if you do not wish to attend Court with the advocate, we will prepare a Witness Statement which you will need to sign. This will cost an additional £50 (plus VAT).
Your witness statement will be filed at the Court and sent to the tenant before the hearing takes place. The advocate will attend the Court hearing and apply for possession of your property, judgment in respect of the arrears of rent, and fixed costs.
After the hearing we will inform you of the outcome.

Please note that this cost only includes the initial hearing. Further costs will be charged to you if a further court hearing is necessary or a defence is filed.

Stage Three – Tenant Eviction

Is your tenant still refusing to leave the property?
Do you want to evict your tenants?

If you have completed Stages 1 and 2 and the tenant still refuses to leave the property, we can issue a Warrant of Possession which will be executed by the County Court Bailiff.
We will issue a Warrant of Possession and inform you of the date of eviction, for which you should be present.
You will also need to arrange for a locksmith to be present at the eviction.
